Custom Illustrations Terms and Conditions

Welcome to Dolly and Moo, thank you for visiting. This website is operated and managed by Dolly and Moo (ABN 91522472994). The below Terms and Conditions apply when enquiring about and purchasing a custom illustration.

General Terms

  • When you submit a Custom Illustration Order Form, you are agreeing to the Terms and Conditions specified in this document.

  • The design process may be documented on social media should you agree to us sharing.

  • The completed design may be documented on social media should you agree to us sharing.

  • Original client photos will not be shared on any social media or internet pages unless permission is granted.

  • Prices are subject to change at the owners discretion.

  • Dolly and Moo has the right to reject any order placed that does not align with company values.

  • Custom Illustrations by Dolly and Moo are intended for private use only. If you require a design for commercial purposes, please enquire via email to hello@dollyandmoo.com.au

Payment

  • Currency accepted is AUD (Australian Dollars).

  • Payments for Custom Illustrations will be accepted via invoice, which will be sent through email, payable with debit/credit cards.

  • The first draft will not be completed until payment is made.

Process and Delivery

  • Once your order is submitted, you will receive an order confirmation and quote within 2 business days, along with a link to upload your guide photo.

  • Once the order is confirmed and guide photo received, you will be sent an invoice and upon payment the design process will commence.

  • The turnaround time for design work will be discussed prior to commencement. This is usually 2 weeks from payment. If you require your art sooner, please specify the date and we will try our best to accomodate.

  • You will receive a watermarked draft to make any changes during the design process. You are allowed 2 draft edits only. Any more will incur further charges.

  • Once the final design has been approved and sent, there will be no further changes made.

  • The final digital files will be uploaded in PNG, JPG and PDF formats to a private Dropbox for you to download and will be available for 30 days.

  • If you require printing and postage, your physical prints will be sent to you within 2 weeks of completion and a tracking number will be provided. If this is not possible, you will be notified.

Copyright and Usage Policy

I, Eloise Martyn (the artist), claim the rights to the produced artwork, therefore I am allowed to use the copyrighted artwork for promotion, publishing and sharing online, print, website, social media, marketing platforms at my discretion.

The buyer is allowed to:

  • Use the commissioned piece for personal use only unless agreed otherwise (use on social media profiles is allowed)

  • Print the artwork and claim the character(s) as their own, but not the artwork itself.

  • Use the artwork for self promotion (social media profile photos, marketing content)

The following is considered copyright infringement:

  • Reproducing/using the copyrighted artwork commercially

  • Claiming the artwork as your own

  • Altering the artwork without my consent

Dolly and Moo reserves the full rights to the image and its use/distribution unless otherwise agreed upon prior to the order commencing.

Customer Satisfaction?

Your experience with Dolly and Moo is important! You can make changes anytime during the design process, but NOT after the final images have been approved and sent to you. Some points in the Terms and Conditions can be discussed prior to commencing design work. If your order has been shipped and it does not arrive, gets lost, or arrives damaged please contact Dolly and Moo via email.

Refund and Cancellation Policy

The client is not entitled to a refund if:

  • They cancel their order after payment has been made

  • They have a change of mind

  • The completed illustration has been digitally delivered

  • The completed portrait has been printed and shipped

  • They claim the print arrived damaged but can’t provide proof of damage

The client is entitled to a full refund if:

  • I am unable to start or finish the commissioned piece

  • They cancel their order before any payment has been made

  • I am unable to deliver the portrait in time due to unforseen circumstances

Damaged/Missing Goods

If your order arrives damaged, please send clear proof (a photo) to hello@dollyandmoo.com.au and options of re-sending or tracking your package will be provided,

Damaged/Missing Goods include:

  • Water damage

  • Ripped art

  • Missing items in order

  • Missing/stolen full order

Privacy

We take your privacy seriously. All personal information collected via www.dollyandmoo.com.au will not be used for anything other than ordering and marketing purposes if you choose to opt in. For more information on Privacy - please see our full terms here.

Policy Changes

Dolly and Moo reserve the right to amend and change the pricing, terms and conditions and privacy information as they see fit, and at any time.
